- 6. What is the purpose and how does the legislatively directed spending item provide a public benefit that is an appropriate use of taxpayer money?
- The Midland County Honest Opportunity Probation with Enforcement (MiHOPE) program is the 42nd Circuit Court's Swift and Sure Sanctions Probation Program (SSSPP). The program is a prison diversion intensive probation which uses strict supervision and enforcement coupled with community resources to break the cycle of substance abuse and crime. On average, it costs $48,000 to house one prisoner per year and therefore, MiHOPE's 65 graduates have saved the State of Michigan over $3 million each year they are in the community and not in prison. The focus is on those who would otherwise be high-risk of going to prison but who can be supervised safely, not on those whose history indicates that community safety may be at risk. Participants are sentenced to a 5-year term of probation where they must maintain sobriety, attend relevant substance abuse treatment as well as group classes, report to probation as instructed, maintain a job or do community service work and pay their fines and costs. All rules are strictly enforced and every failure to meet the requirements is a violation of probation and is sanctioned. When a participant makes two years with no violation, other than being late to an appointment, they are discharged successfully. Participants who demonstrate lack of effort or can no longer be supervised are discharged unsuccessfully and sentenced to prison. SSSPP is a line item in the Judiciary budget. The State Court Administrative Office (SCAO) administers SSSPP and distributes grants to qualifying courts. This line item received a significant reduction in the FY25 budget. Previous award amounts for the 42nd Circuit Court specifically by fiscal year in the last 5 years: - FY22: $266,092 - FY23: $270,000 - FY24: $285,000 - FY25: $285,000 - FY26: $104,097 While receiving a significant deduction from the State, the community recognizes the importance of MiHOPE and the 42nd Circuit Court received a $37,200 grant from the Midland Area Community Foundation for recovery coaching. Midland County also agreed to utilize their opioid settlements fund to fill gaps for this year, up to $157,059.
